The essay explores the concept of modern insolvency and its implications in light of the principle of pacta sunt servanda. It, derived from Roman law, translates to ‘‘agreements must be kept’’ and is a fundamental principle of contract law. In recent times, insolvency has taken on new dimensions due to complex financial systems and global economic interdependencies. The essay examines how the principle of pacta sunt servanda interacts with modern insolvency frameworks and the legal rights and obligations of all parties involved.
The paper deals with fundamental issues concerning liability for autonomous systems. The analysis considers the current rules in European jurisdictions – in particular the structures and categories of fault-based liability, strict liability and product liability – and investigates the extent to which legal innovation is required to cope with the new challenges of technological progress. In this context the Author discusses the initiatives developed by the European Union to regulate automation, namely the proposals for directives on artificial intelligence liability and on liability for defective products, as well as the Artificial Intelligence Act, adopted in May 2024. The characters of the experiences of Restorative Justice in criminal matters and the exploration of the vital paths of development that show their dialogical fields are placed in a broader focus on the practice of justice in the dynamics of the state-community: enhancing the keys of complexity theories, the essay explores the plural dynamics of the «time of justices» and inscribes in this context the analysis of Italian experiences of Restorative Justice in criminal matters. The 2022 reform, which structured a statutory discipline of Restorative Justice for the first time in Italy, has opened a complex phase of scientific and institutional debate, in which there have been significantly critical voices with regard to doubts of compatibility with the system of constitutional guarantees of context: there is, however, a need to ensure that the debate is permeated by the election of broader horizons of meaning, by creating the conditions so that, in keeping with the ontological features of Restorative Justice, the promotion of a new mental habitus of institutional actors and cultural contexts is a priority.
Una disamina delle recenti riforme in ambito penale disvela la presenza di visioni politicosociali non soltanto diverse, ma a volte in netta contrapposizione. Da un lato, una prospettiva che tende a ispirarsi al più alto costituzionalismo, al fine addirittura di ridurre il ruolo della violenza/afflittività nella gestione delle dinamiche punitive; dall’altro lato, una prospettiva che invece si ispira a una visione populista diretta a valorizzare sempre di più la dimensione repressiva del diritto penale e quindi ad entrare in tensione con i limiti alla politica posti dal costituzionalismo. Di recente la tensione tra populismo e garanzie sembra essersi fatta ancora più acuta, con il rischio di aprire un conflitto tra legittimazione democratica e legittimità costituzionale che può essere molto rischioso per la stessa tenuta delle istituzioni. Da qui l’auspicio di un ritorno a una visione di dialogo e condivisione sui principi fondamentali sui quali si basa la nostra convivenza costituzionalmente orientata.
The essay addresses the issue of custodian or child services liability for damages to children in foster care and to their parents. Since there are no specific rules, the problem must be dealt with the general ones, but taking into consideration that such a question arises into the family law context. The author proposes to look at contractual liability rather than tort law on the grounds that parties involved in the foster care are linked by a specific legal relation. Children and their parents, in other words, have a legitimate expectation that custodians, child services, and to some extent judicial authority too, will be able to prevent them from suffering harm. Into the private law frame of reference this is a duty of protection, and its breach is precisely governed by the contractual liability rules. However, due to the fact that child services, judicial authority, and custodians are linked in carrying out their duties, the options about the allocation between these parties of liability for damages to children and their parents are also explored. Finally, the writing turns to the question of possible parents’ contributory negligence due to a breach of their educational responsibility under article 1227 of the Civil Code.
The paper deals with open adoption. In general terms, it means that the adoptee and the birth family are allowed to have contacts after the adoption. In the Italian legal system, this possibility was recently confirmed by the Constitutional Court with the decision No. 183/2023, examined in the present writing. The author considers the legal, psychological and social reasons that suggest openness in adoption and discusses important issues, also on the basis of some European legislations that admit open adoption.
